Full terms and conditions of buying

1. BIDDING

1.1 Participation in bidding takes place with customer number and password obtained after application. Bids submitted are binding.

1.2 The buyer will be the person who submitted the highest accepted bid at the end of the auction. If two bidders have submitted equal bids, the bid submitted first is the winner.

2. ABSENTEE BIDS

2.1 Participation in bidding can also take place by submitting an absentee bid which is submitted in writing to Dalarna Auktionsbyrå.

2.2 When submitting an absentee bid, identification must be presented. Dalarnas Auktionsbyrå reserves the right to disregard the absentee bid if the client is deemed not to have the ability to pay for the submitted bid.

2.3 Dalarnas Auktionsbyrå treats all absentee bids confidentially and bids on behalf of the client as favorably as possible.

2.4 The buyer is the person who submitted the highest bid at the end of the auction. If two bidders have submitted equal bids, the bid submitted first is the winner.

2.5 Dalarnas Auktionsbyrå is not responsible for damage that may be caused to the client if Dalarnas Auktionsbyrå neglects to carry out the absentee bid.

2.6 The client is responsible for purchases registered based on an unclear or incorrect absentee bid.


3. BUYERS PREMIUM

3.1 The buyers premium is the additional fee of 25% incl. VAT on the hammered amount and a hammer fee of SEK 50 incl. VAT.

3.2 In accordance with the Act (1960:729) on copyright for literary and artistic works, a droit de suite/following right is added with a maximum of 5% of the hammered price for the sale of works of art, ceramics, glass, silver, furniture and textiles. Only works protected by copyright are covered. Copyright protection lasts for 70 years after the year an author dies. Exempted from the droit de suite are sales not exceeding 5% of the price base amount and applied art objects produced in several identical copies. Works covered by droit de suite are marked with information about resale rights in connection with the cataloging.

4. RESULTS

4.1 It is up to the buyer to check whether their bid led to a purchase.

4.2 Buyers receive after the auction a confirmation of the purchase, either via e-mail or via letter, alternatively confirmation and invoice can be obtained under My pages.

5. PAYMENT

5.1 Payment can be made to our bank giro 5498-3051. Enter customer number when paying. Payment can also be made by card on the website or in our premises. We do not accept American Express. Payment must be made within 5 days of the auction.

5.2 If payment is not made on time according to point 6.1, Dalarnas Auktionsbyrå has the right to take one or more of the following measures:

(i) Cancel the purchase.

(ii) Demand payment.

(iii) Debit SEK 50 in reminder fee.

(iv) Charge late payment interest of 2% per month

(v) Resell the item on behalf of the buyer without special notification to the buyer.

Dalarnas Auktionsbyrå has full and unrestricted right to determine the asking price and whether or not the item shall be assigned a reserve price. Dalarnas Auktionsbyrå has the right to charge compensation for all claims that Dalarna Auktionsbyrå has against the buyer from the amounts received.

6. COLLECTING

6.1 Purchased items can be collected as soon as full payment has been made and received by Dalarnas Auktionsbyrå. Items must be collected within 5 days of the auction, unless otherwise agreed.

6.2 A storage fee is charged for items that are not collected in time according to point 7.1.

6.3 Dalarnas Auktionsbyrå's responsibility for care of the items ceases if collection has not taken place in time according to p. 7.1.

6.4 For items that are not picked up within 5 days of the auction, Dalarnas Auktionsbyrå has the right to take the following measures: (i) Sending items to warehouse at any forwarding company. All transport and storage costs are charged to the buyer. (ii) Resale of the item on behalf of the buyer without special notice to the buyer. Dalarnas Auktionsbyrå has full and unrestricted right to determine the asking price and whether or not the item shall be assigned a reserve price. Dalarnas Auktionsbyrå has the right to charge compensation for all claims that Dalarna Auktionsbyrå has against the buyer from the amounts received.

6.5 All transport of items to the buyer takes place at the buyer's expense and at the buyer's risk. Transport fee is charged according to the current price list.

7. RESPONSIBILITY FOR ERRORS

7.1 All items are sold as is. It is the buyer's responsibility to assess the item's condition and condition through his own examination of the item before the auction. Dalarnas Auktionsbyrå is not responsible under any circumstances for natural wear and tear, minor damages and defects, possible feeding of canvases, condition of frames, natural changes in living materials such as fading of paper and cracking in wood.

7.2 Clocks and clockwork are sold as works of art and Dalarnas Auktionsbyrå is not responsible for them functioning technically as timepieces. We are not responsible for the function of mechanical or electrified/battery-powered objects.

7.3 Information provided regarding, for example, author, age, technology, provenance or condition only serves as a guide for the buyer when examining the item. Dalarnas Auktionsbyrå is not responsible for such information being incorrect, unless the incorrect information was provided due to gross negligence.

7.4 Imaging of objects is for identification purposes only. Dalarnas Auktionsbyrå is not responsible for damages or defects that are not apparent from such a depiction.

7.5 Items are sold in accordance with the description provided. Dalarnas Auktionsbyrå reserves the right to change such description. Such change is specified separately.

7.6 Dalarnas Auktionsbyrå reserves the right to correct such errors in sold items for which Dalarna Auktionsbyrå is responsible. If remedial measures are not taken place within a reasonable time from the time a complaint regarding the fault is made, the buyer has the right to cancel the purchase and, in return for the return of the object, receive the amount paid to Dalarna Auctions byrå at the time of purchase. The buyer is not entitled to any additional compensation.

7.7 Any errors must be reported immediately after the buyer discovers or fails to discover the error, but no later than 7 days after the auction day. Complaints regarding information about the author as stated in point 8.3 must, however, be made no later than 3 years from the purchase.

7.8 Dalarnas Auktionsbyrå's liability for errors is limited to what is stated in these terms and conditions.

7.9 Dalarnas Auktionsbyrå does not guarantee that the services at http://dalarnasauktionsbyra.se are constantly available. Dalarnas Auktionsbyrå is not responsible for any inconvenience or financial effects that customers experience due to the bidding function or other functions not being available at all times.

8. RIGHT OF WITHDRAWAL

8.1 Dalarnas Auktionsbyrå conducts all our auctions as live hammer auction and the right of withdrawal does not apply. There is therefore no right of withdrawal, regardless of whether bids were submitted via written assignment, on site, via the internet or by phone bid. See ch. 2 11 § 10. the Act (2005:59) on distance contracts and contracts outside business premises.

9. DELIVERY DELAY

9.1 If the delivery delay, depending on conditions for which Dalarnas Auktionsbyrå is responsible, lasts more than 20 working days and is of significant importance to the buyer and Dalarnas Auktionsbyrå do not realize this, the buyer has the right, by written notice to Dalarna Auktionsbyrå, to cancel the purchase and receive the amount paid to Dalarna Auktionsbyrå at the time of purchase. The buyer is not entitled to any additional compensation.

10.2 Dalarnas Auktionsbyrå's liability in the event of delay is limited to what is stated in these terms and conditions.

10. FORCE MAJEURE

10.1 Dalarnas Auktionsbyrå is exempt from penalty for failure to fulfill a certain obligation under this agreement if the failure is based on a circumstance of the kind stated below and the circumstance prevents or significantly complicates the timely fulfillment thereof. Acts of war, currency restrictions, shortage of means of transport, fire, action by authorities, changed legislation, labor conflict, general shortage of goods, reductions in driving force, accidents or similar circumstances shall be regarded as liberating circumstances. If Dalarnas Auktionsbyrå's fulfillment of a certain obligation is delayed by more than three months due to an extenuating circumstance, the buyer has the right to cancel the purchase in writing without liability for compensation.

11. DISPUTE

11.1 Disputes regarding these conditions shall be settled according to Swedish law at a court in Sweden.
